In 2022, an individual sued two members of the Revere Police Department along with a private citizen. The plaintiff alleged that he entered into a business partnership concerning real property with the private citizen and, after a period of time, the relationship soured. Members of the Revere Police Department became involved in the dispute in various ways over time and, the plaintiff claimed, two officers acted unconstitutionally and impermissibly when, taking the side of the former business partner, the officers searched and seized the plaintiff’s property without justification, failed to assist the plaintiff in his claims against the former partner, acted so as to secure the suspension of the plaintiff’s license to carry and then made false statements in connection with a harassment prevention order. The plaintiff asserted that the officers’ actions violated a number of the plaintiff’s constitutional rights.
RJA Attorney Mike Akerson represented the Revere police officers in the federal court where the lawsuit was commenced. The federal judge presiding over the case dismissed the plaintiff’s claims prior to discovery and the plaintiff appealed that decision to the First Circuit Court of Appeals. On appeal, RJA Attorney Andy Gambaccini represented the officers. In 2024, after briefing, the First Circuit affirmed the dismissal of the case, concluding that the plaintiff had not stated any plausible claim against the officers.
