RJA successfully defends member of the Massachusetts State Police against civil rights claims pending before the First Circuit Court of Appeals
Recently, RJA was retained by a Lieutenant with the Massachusetts State Police to represent him in an appeal pending before the First Circuit Court of Appeals in Boston, Massachusetts. The Lieutenant had been involved in a criminal investigation arising out of a sexual assault in Springfield, Massachusetts; that investigation led to the indictment of the plaintiff. After the criminal charges against the plaintiff later were dropped, the plaintiff sued. In his complaint, the plaintiff claimed that his constitutional rights had been violated and sought $2.2 million in damages.
RJA prepared the appellate brief on behalf of the Lieutenant and, in a decision issued on February 4, 2013, the First Circuit Court of Appeals ruled in favor of the Lieutenant and rejected the plaintiff’s constitutional and other claims.
RESULT: Judgment issued by the First Circuit Court of Appeals in favor of RJA’s client.
